Terms of Service
These Terms govern access to and use of BlobShift websites, APIs, SDKs, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
BlobShift provides a managed image processing pipeline for developers: upload, optimize (WebP/AVIF, resize, smart crop, watermark, EXIF scrub), and short-retention CDN delivery. We host storage and delivery infrastructure; bring-your-own buckets are not offered in the current product. Video processing is not part of the current Service.
2. Accounts
You must provide accurate account information and keep credentials (including API keys) confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use at support@blobshift.com.
3. Acceptable use
You may not use the Service to:
- Violate law or third-party rights (including copyright and privacy).
- Distribute malware, phishing content, or abusive material.
- Attempt to disrupt, probe, or bypass security or rate limits.
- Resell raw capacity in a way that circumvents plan limits without our written consent.
We may suspend or terminate access for violations or risk to the Service.
4. Your content
You retain ownership of content you upload. You grant BlobShift a limited license to store, process, transcode (where applicable), cache, and deliver that content solely to operate the Service for you. You represent that you have the rights needed to upload and distribute your content.
5. Plans, fees, and taxes
Paid plans are billed according to the pricing presented at purchase. Fees are generally non-refundable except where required by law. Applicable taxes may be added. We may change pricing with notice for subsequent billing periods.
6. Availability and changes
We aim for high availability but do not guarantee uninterrupted Service. Features may evolve; we will use reasonable efforts to avoid breaking documented APIs without notice.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOBSHIFT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
9. Indemnity
You will defend and indemnify BlobShift against claims arising from your content or your misuse of the Service.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or risk. Upon termination, your right to use the Service ends; provisions that should survive (including ownership, disclaimers, and liability limits) will survive.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict of law principles, unless mandatory local consumer law provides otherwise. Courts in Chennai, Tamil Nadu shall have exclusive jurisdiction, subject to applicable mandatory rights.
